On remand from Fisher I the Court of Appeals reexamined the admissions program at the University of Texas and applied the proper legal standard, strict scrutiny. In a closely divided decision, the Court agreed, holding that the university’s use of race could survive strict scrutiny and providing direction regarding both the bases that justified such policies and the manner in which they should be implemented.
