In the first of two decisions involving the use of race in the admissions process at the University of Texas, the Supreme Court reiterated its prior holdings that the use of race as a consideration in admissions must survive strict scrutiny review, but did not reach the merits of the case, finding that the Court of Appeals had not properly applied that standard. It accordingly sent the case back for further consideration.
